From 1 August 2025, all freehold property sales in Queensland — including houses, units, commercial properties, and vacant land — will be subject to new mandatory disclosure obligations aimed at increasing transparency and improving buyer confidence.
The reforms, introduced under the Property Law Act 2023, require sellers to provide prospective buyers with a Form 2 – Seller Disclosure Statement and supporting prescribed certificates. These include documents such as a title search, zoning details, environmental notices, and a body corporate certificate if relevant.
According to the Department of Justice, “The buyer must receive the disclosure documents before they sign the contract.
“For auctions, the documents must be provided or made available before the fall of the hammer.”
The new disclosure scheme gives buyers stronger protections. If the statement or certificates are “missing or… incomplete or incorrect — and it affects something important the buyer didn’t know — the buyer may be able to cancel the contract at any time before settlement.”
The Department also notes that “there may also be other legal remedies available depending on the information.”
Real estate professionals are expected to play a key role in supporting compliance. As the Department states: “As a real estate professional, your role is more important than ever in helping sellers get it right early.”
The scheme is designed to promote “transparency and… informed decision-making in property transactions.”
